1. USER AGREEMENT

By accessing and using digital products, including but not limited to thektruth.com, and mobile applications ("Sites" or "Services"), you ("You" or "User") agree to comply with the terms and conditions outlined below. These terms are subject to periodic updates or modifications entirely at the discretion of THE KTRUTH. Your subscription period is governed by this agreement, and you acknowledge that you are bound by these terms during your access to the Sites. Additionally, if you use our other digital products, such as RDF Site Summary (RSS), fees, APIs, and Software, you are also bound by these Terms & Conditions.

Accessing the Sites or Services signifies your understanding and acceptance of these terms and conditions. By using the Sites or Services, you confirm that you have the legal authority, including meeting the age requirements set forth by applicable laws, to accept these terms on your own behalf or on behalf of any other individuals you represent. If you do not agree with these terms, you are not permitted to use the Sites or Services.

You further affirm and guarantee that you are at least eighteen (18) years old or older, possessing the capacity to enter into and comply with these Terms. Individuals under the age of 18 can access and use the Sites only with parental or legal guardian supervision and guidance.

To utilize the Sites and Services, you are required to register and provide accurate personal information, including your complete name, age, email address, residential address, and contact number, before uploading any content, making comments, or using any other Services offered on the Sites.

2. AMENDMENTS AND REVISIONS

We retain the right to amend, delete, edit, update, or modify these Terms & Conditions and the User Agreement, including the ability to suspend, terminate, or discontinue any or all Sites or Services, or specific sections thereof, at any time without prior notice. Additionally, we may edit, delete, update, modify, or alter any content, products, or services, or portions thereof, without advance notice ("amendments and revisions"). These modifications and changes become effective immediately upon being posted on this page. It is your sole responsibility to regularly review these Terms and Conditions before using the Sites. By continuing to access the Sites following any such amendments and revisions, you are considered to have accepted all of these modifications and changes.

3. REGISTRATION

Upon registration, you are registering as an individual user of the Sites. Access to registration areas requires your email address and password. Your access to the registration areas of the Sites is subject to the following conditions:

(i) Your email address and password are personal and should not be shared with others. If you are under 18 years of age, your registration requires approval from your Guardian. It is your responsibility to provide accurate age information if you are a minor.

(ii) You are not permitted to assist or enable unauthorized users in gaining access to the Sites. If it is found that you have allowed others to access the Sites via your login credentials, we reserve the right to revoke, suspend, or terminate your access to the Sites and block access from your IP address. In such cases, you agree that we may collect damages and your subscription amount shall be forfeited.

(iii) Creating multiple registration accounts for abusive purposes or impersonating other users is strictly prohibited.

(iv) We are not liable for unauthorized access, alteration of your data, or any material sent or received through the Sites.

(v) Compliance with these terms and conditions is mandatory. Non-compliance may result in the cancellation of your access to the registration areas of epaper.indianexpress.com without prior notice.

(vi) By registering, you authorize us and our Affiliates to collect and store your personal data submitted during the registration process.

(vii) Registration via Facebook Connect: You may register using your Facebook credentials, but if you are under 18, you can do so only under parental or legal guardian supervision. When using Facebook Connect, your activity on the Services may be shared on your Facebook account. You are responsible for managing your Facebook account privacy settings. Each registration pertains to a single individual user. By registering through Facebook, you agree to these Terms and any additional specific terms posted on the Site.

4. Limited License:

Provided you adhere to the terms outlined herein, we hereby provide you with a personal, restricted, non-exclusive, non-transferable license to utilize the Services solely for personal and non-commercial purposes. Apart from this limited license, no ownership, title, or interest in the Services is transferred to you. The content available on the Site and/or the Services is provided "AS IS" for your personal information and use and must not be utilized for any other purposes, including but not limited to copying, reproduction, distribution, transmission, broadcasting, display, sale, licensing, or exploitation without the prior written consent of the respective owners. We retain all rights not explicitly granted in relation to the Sites and/or the Services and their content.

These Terms do not grant you the authority to reproduce, distribute, publicly display, publicly perform, communicate to the public, make available, create derivative works, or exploit any Third-Party Content or User Submissions in violation of applicable copyright laws. Unauthorized use of the content or the Services will result in the termination of the limited license provided by us and the cancellation of your membership. Engaging in unauthorized activities through the Sites or the Services may lead to significant civil and criminal penalties. We neither encourage nor condone content copying or any other infringing activities, and owners of Third-Party Content or User Submissions may have the right to seek damages for any such violations.

5. Subscription Services Terms and Conditions

A. Subscription Services Overview: As part of the Services, THE KTRUTH offers personal subscription services to users for fees, granting access to The KTruth e-paper and/or premium content. Subscribers gain access to specially curated opinion pieces, comments, and exclusive features chosen by the editors. Content behind the paywall is subject to change at THE KTRUTH’s discretion, and its decisions in this regard are final.

B. Subscription Fees and Payment: Subscription fees are non-refundable, except as specified in clause 7.1. THE KTRUTH reserves the right to change subscription fees and terms without prior notice. Subscription rates may vary based on location and device. Subscribers must provide accurate payment details; failure in payment authorization may lead to suspension of access. Refunds, when applicable, will be credited to the original payment method.

C. Subscription Contract and Pricing: Upon submitting payment details, users make an offer to purchase a subscription. THE KTRUTH accepts this offer upon successful verification of payment details and email address. Prices, subscription frequencies, and currencies are clearly stated during the sign-up process. Users are responsible for internet or telecommunications charges related to accessing the Services.

D. Term, Renewal, and Cancellation: Subscriptions renew automatically, and users are notified via email prior to renewal. Cancellation requests must be made at least 5 business days in advance. Annual subscribers receive renewal reminders 15 days before renewal. Cancellations only take effect at the end of the current subscription period; refunds are not provided except in specific circumstances.

E. Right to Include Advertising: THE KTRUTH reserves the right to include advertising, promotions, and sponsored content in the Services, including subscribed and/or premium content.

F. Termination and Refunds: THE KTRUTH may cancel subscriptions in case of user breach or disputes, refunding fees pro rata. Subscriptions may also be suspended or terminated for breach of Terms or unforeseen circumstances, with refunds for the unexpired period.

G. Payment Details and Fee Revision: The current Subscription Fees schedule is available at https://thektruth.com/subscribe. Fees may be revised periodically; users are advised to review the pricing structure regularly.

H. Definition of ad-lite:

Active subscribers experience fewer ads than non-subscribers.
Relevant* ads are shown to subscribers who update their profile and interests.
Applicable on web and m-site interfaces, not on the app or e-paper.
THE KTRUTH reserves the right to change the number of ads shown based on user discretion and extend ad-lite to non-subscribers at its discretion.

*Relevance is determined by users' explicit areas of interest and preferences in the account section.

6. Intellectual Property

Unless otherwise specified, all intellectual property, including trademarks, service marks, copyrights, and all other rights in the material presented on the Sites (such as text, audio, video, or graphical images) belongs to us or our duly licensed affiliates. This intellectual property is protected under applicable law. You acknowledge that you do not have any rights, titles, or interests in this intellectual property and you shall not claim any such rights in the present or future. Any infringement or passing off of our intellectual property will be pursued to the maximum extent allowed by law.

7. Termination of User Agreement

7.1. Changes and Termination of Services: We reserve the right to change, suspend, or permanently or temporarily discontinue some or all of the Services (including content and devices used to access the Services) for any or all users at any time without notice. You acknowledge that we may exercise this discretion. We shall not be liable to you for any modification, suspension, or discontinuance of the Services. If you are a paid subscriber and we suspend or discontinue the Services, we may, at our discretion, provide you with a credit, refund, discount, or other form of consideration. However, if we terminate your account due to your violation of these Terms, you will not be eligible for any such consideration. We may retain necessary information and records even after termination as required by applicable laws.

7.2. Email Notification of Termination: If we need to terminate the agreement, we will notify you via email at your registered address. The agreement will terminate immediately, making your email address and password invalid on the Sites or epaper.indianexpress.com. If we terminate the agreement due to the discontinuation or transfer of the Sites, changes in commercial or environmental conditions, force majeure conditions, or breaches by you, we will refund your subscription amount pro rata.

7.3. Suspension or Termination by Us: We may, at our sole discretion, terminate or suspend your access to all or part of the Sites for any reason, including breach or suspected breach of these Terms & Conditions or disputes raised by you.

8. Restricted Permission for Personal Use:

You are allowed to download extracts exclusively for your personal and non-commercial use on your personal device and printer from these Sites. Any copies from the Sites to any other storage medium are not permitted. You are prohibited from creating a database by systematically downloading and storing pages from the Sites. Archiving, storing, transferring, or caching the website or its parts is not allowed. Reproduction, transmission, editing, or storage of any part of the Sites on other websites, blogs, or mediums, or inclusion in any public or private electronic retrieval system or services is strictly prohibited without our prior written permission and payment of requisite fees, subject to the terms and conditions thereof.

Copying, curating, editing, or storing content from the Sites for non-personal or third-party use is strictly prohibited. Printouts or downloads of copyrighted content from the Sites for non-personal or non-commercial use are allowed only with our prior written permission, subject to terms, conditions, and acknowledgment of copyright and other notices contained therein.

9. Prohibited Use:

You are strictly prohibited from accessing, copying, editing, archiving, printing, downloading, displaying, uploading, or attempting any of these actions on the Sites (including e-papers) or any content therein, with the intention to harm us, the copyright owner, licensor, our affiliates, subsidiaries, associates, or any third party. Any such use must comply with applicable laws and not infringe upon our or any party’s intellectual property or legal rights. Circumventing, reverse engineering, decrypting, or interfering with the Sites or any part of it, either by you or a third party, is also prohibited. Violation of these terms may result in civil, criminal, and/or administrative penalties against you and any assisting parties. Sharing, displaying, uploading, copying, or using the Sites or any part thereof for subscription or any internet or digital-based "teaching" or "discussion" activity is strictly forbidden and constitutes infringement.

Reselling or commercially using any part of the Site, collecting and using product listings, descriptions, or prices, derivative use of the Site or its contents, downloading or copying account information for the benefit of any other merchant, renting, leasing, transferring rights, displaying names, logos, trademarks, or identifiers of other entities in a manner that implies their association with the Services, using data gathering or extraction tools, or creating a database by systematically downloading and storing pages from the site, directly or through software programs, are all strictly prohibited.

10. Third-Party Content

10.1. Third-Party Promotional Content: You may encounter advertorials, advertising, promotional or sponsored content, or links to third-party websites submitted by third parties on the Sites ("Third-Party Promotional Content"). Individual advertisers and releasing parties are solely responsible for this content, ensuring its compliance with relevant legislation, rules, and regulations, and confirming its legality, morality, and adherence to public policy. Third-Party Content: You may come across press releases, agency reports, or content created by the copyright owner, licensor, contributor, or third parties ("Third-Party Content") licensed to us. These parties are solely responsible for such Third-Party content, ensuring its compliance with the law.

10.3. No Endorsement or Control: We neither control nor endorse Third-Party Promotional Content. Users must conduct necessary inquiries before engaging in transactions or sharing money, data, personal information, etc., or contracting with third-party promotional content in any manner.

Ownership: The Sites, Services, and THE KTRUTH content (including THE KTRUTH’s trademarks and logos available through the Sites and Services, excluding Third-Party Content and User Submissions) are protected by copyright, trademark, and other applicable laws. Except as expressly provided in these Terms, THE KTRUTH and its licensors exclusively own all rights in the Sites, Services, and the THE KTRUTH Content, including associated intellectual property rights. You may not remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated with the Sites, Services, or THE KTRUTH Content. THE KTRUTH has no ownership interest in any Third-Party Content and disclaims liability concerning these materials.

11. Interaction Between Users

You are solely responsible for your interactions, including disputes, with other users. We do not screen users. Therefore, you must exercise caution, discretion, and judgment when using the Sites and Services and sharing personal information with other users. You agree to take reasonable precautions and cooperate fully with us to investigate any suspected unlawful, fraudulent, or improper activity via the Services.

By making User Submissions available through the Sites and Services, you grant us and its users a worldwide, non-exclusive, perpetual, irrevocable, transferable, royalty-free license to use, copy, adapt, modify, distribute, display, perform, transmit, stream, broadcast, make available, communicate, or otherwise exploit such User Submissions. We do not claim ownership rights in any User Submissions, and we shall not be liable for any third party's use of your User Submissions. We reserve the right to not publish, display, or delete any User Submissions that are infringing or in violation of applicable laws. ii. You assure that you will not pretend to be any person or organization, including us, an official, forum leader, guide, or host, nor falsely claim or misrepresent your affiliation with any individual or entity.

iii. You pledge not to harm, influence, or make inappropriate contact with minors or vulnerable individuals in any manner.

iv. You commit to refraining from altering headers or manipulating identifiers to conceal the source of any content transmitted through the service.

v. You agree not to share, upload, post, email, or transmit any content or comment that infringes upon, passes off, or harms the patent, trademark, service mark, trade secret, brand, copyright, or other proprietary or personal rights (“Rights”) of any party.

vi. You ensure that you will not upload, post, email, transmit, or otherwise share any content that you do not have the right to share under any law or under contractual or fiduciary relationships (such as insider information, proprietary, privileged, and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).

vii. You commit to abstaining from sending unsolicited or unauthorized advertising, promotional materials, false or fraudulent advertising, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation.

viii. You pledge not to share, upload, post, email, or transmit any content containing software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer resource.

ix. You will not publish content that threatens the unity, integrity, defense, security, and/or sovereignty of India or its borders, friendly relations with foreign states, public order, or causes incitement to the commission of any cognizable offense or prevents the investigation of any offense, or insults any other nation, or displays incorrect borders or territory of India.

x. You will not publish content that violates relevant laws and/or is subject to investigation under appropriate laws. Furthermore, non-compliance with laws, these terms, or the Sites' privacy policy may result in the termination of your account/blocking of your access to the Sites, and we reserve the right to remove any non-compliant content uploaded by you.

xi. You pledge not to use, upload, post, email, transmit, or otherwise share content to cache or archive content from the Sites or any part thereof.

xii. You are assured not to use, upload, post, email, transmit, or otherwise share any content, device, or software designed to or having the effect of circumventing any restriction, condition, or technological control to access the Sites, including overriding or bypassing any security features, controls, or limits.

13. Disclaimer
13.1. All the contents of the Sites are only for general information or use. They do not constitute advice and should not be relied upon in making (or refraining from making) any decision or action. Any specific advice or replies to queries in any part of the Sites is/are the personal opinion of such experts/consultants/persons and are not subscribed to by the Sites. Certain links on the Sites lead to resources located on servers maintained by third parties over whom we have no control or connection, business or otherwise as these sites are external to us and you agree and understand that by visiting such sites you are beyond our Sites. We therefore neither endorses nor offers any judgement or warranty and accepts no responsibility or liability for the authenticity/availability of any of the goods/services/or for any damage, loss or harm, direct or consequential or any violation of local or international laws that may be incurred by your visit and/or transaction/s on these sites.

13.4. Whilst care is taken prior to acceptance of Third-Party Promotional Content, it is not possible to verify the same. 14. Indemnification

By using the Sites, you agree to indemnify and protect THE KTRUTH, its subsidiaries, affiliates, directors, shareholders, officers, employees, and representatives from any claims, demands, losses, costs, liabilities, expenses, or damages, including reasonable attorney’s fees and litigation costs, made by any third party due to or arising from your use of the Sites in violation of these terms and conditions. This indemnity provision, in addition to your assurances, warranties, and commitments, will remain valid even after the termination of the User Agreement. We reserve the right to disclose your personal information and details about your use of the Sites, including its contents, without your explicit consent if we have a genuine belief that such action is necessary to: (a) comply with legal requirements or adhere to legal procedures; (b) safeguard and defend our rights or properties; (c) enforce these Terms & Conditions; (d) protect the rights and well-being of minors, the general public, third parties, or others.

15. Force Majeure

While we strive to maintain uninterrupted access to the Sites, we cannot guarantee it. We assume no responsibility or liability for any interruptions, delays, or disconnections caused by force majeure or acts of God.

16. Sharing Content from the Sites

The contents of the Sites are confidential and should not be shared with anyone. However, this restriction does not apply to sharing individual articles on social media platforms for the purpose of initiating discussions and expressing opinions.

17. Your Responsibilities

Upon using the Site and/or the Services, you affirm and guarantee to THE KTRUTH that you will employ them solely for legal purposes and will not violate any laws, regulations, ordinances, or other requirements stipulated by any applicable Central, State, or local government or international laws. You specifically commit to adhering to the provisions of the Information Technology Act, 2000, as well as the rules, regulations, guidelines, bylaws, and notifications established under it while using the Site. Additionally, you agree not to:

a. bypass, modify, deactivate, diminish, or obstruct any content protections on the Sites or the Services.

b. copy, download, capture, reproduce, duplicate, archive, distribute, upload, publish, modify, transform, translate, broadcast, perform, display, sell, transmit, disseminate, or retransmit any content or any part thereof directly or indirectly, except when expressly permitted by us, using any device, software, website, web-based service, or other methods.

c. remove, alter, bypass, avoid, interfere with, or circumvent any copyright, trademark, or other proprietary notices displayed on the content or any digital rights management mechanism, device, or other content protection or access control measure associated with the content, including geo-filtering mechanisms, either directly or indirectly through any device, software, website, web-based service, or other means.

d. use the Sites or the Services in a manner that could harm, disable, overload, or impair them or undertake any action that is harmful or potentially harmful to any THE KTRUTH server or network, computer systems, or resources connected to any THE KTRUTH server, or interfere with any other party’s use and enjoyment of the Sites or the Services;

e. obtain or attempt to obtain any materials or information through any means not intentionally made available through the Sites/Services;

f. engage in any activity likely to cause such harm;

g. carry out any “denial of service” (DoS, DDoS) or any other harmful attacks on Sites or internet service or;

h. use the Sites or the Services for illegal or unlawful purposes;

i. disrupt, overload, interfere with, or attempt unauthorized access to the Sites, our website, or any other website or computer system owned by us or our customer;

j. manipulate headers or identifiers to conceal the source of any content transmitted through the Sites or the Services;

k. attempt unauthorized access to the Services, other accounts, and computer systems through hacking, password mining, or any other means. You shall not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Sites or the Services;

l. integrate the Sites or Services into or retransmit via any hardware or software application or make them available via frames or in-line links without our express written permission;

m. create, recreate, distribute, or advertise an index of any significant portion of the Sites or Services unless authorized by us;

n. use any “robots”, “spiders”, “offline readers”, or any other automated system to access the Sites or the Services in a manner that sends numerous automated requests to the Sites’ servers within a given period, which a human cannot reasonably send using conventional web browsing applications or tools for similar purposes;

o. send or post any unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters, or any form of solicitation that requests login information or access to someone else’s account;

p. use the Sites, Services, or THE KTRUTH Content for commercial purposes or for the benefit of any third party or in any manner not allowed by these Terms of Use;

q. impersonate or misrepresent your affiliation with any person or entity;

r. encourage or enable any other individual to engage in any of the aforementioned activities.

Moreover, you are expressly prohibited from creating derivative works or materials based on the content, including montages, mash-ups, videos, wallpapers, desktop themes, greeting cards, and merchandise, unless expressly permitted by THE KTRUTH in writing. This restriction applies even if you intend to distribute the derivative materials for free.

If you are a publisher of news and current affairs content, you must provide details of your user accounts on our Services to the Ministry of Information and Broadcasting as required by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“Rules”) in addition to complying with other terms mentioned herein. THE KTRUTH may, at its discretion, provide such publishers who have submitted information under said Rules to the Ministry of Information and Broadcasting, a visible mark of verification indicating their status as publishers, visible to all service users.

The Site may allow you to post User Submissions such as reviews of content available through the Services, comments on such content, etc. You understand that once posted, these User Submissions are visible to all members since it is a public forum. Specifically, when you review/rate any content available on the Services (as per the functionality on the Sites), you grant THE KTRUTH the right and consent to display your rating/review related to the relevant Content on the Sites, including making it available to other members. If you do not want your User Submissions/reviews/ratings to be shared publicly, refrain from using these features. Note that these features are subject to change without notice, and associated information sharing and functionality levels may also change without notice.

We have the liberty to use any comments, information, ideas, concepts, reviews, or techniques or any other material contained in any communication you send to us (“User Feedback”), including responses to questionnaires or through postings on the Services/the Sites and User Submissions, without further compensation, acknowledgment, or payment to you for any purpose, such as developing, manufacturing, and marketing products and enhancing the Services. By posting/submitting any User Feedback/User Submission on the Sites, you grant THE KTRUTH a perpetual, worldwide, non-exclusive, royalty-free, irrevocable, sublicensable license and right to use, display, reproduce, or modify the User Feedback/User Submission in any media, software, or technology existing now or developed in the future.

Operators of public search engines are allowed to use functionalities like spiders to copy materials from the Sites solely to create publicly available searchable indices of the materials, not caches or archives of such materials. We retain the right to revoke these exceptions at our sole discretion, either generally or in specific cases. You agree not to collect or harvest any personally identifiable information, including account names, from the Sites, nor use the communication systems provided by the Sites for any commercial solicitation purposes. You agree not to solicit any users of the Sites for commercial purposes regarding their User Submissions.

You are financially responsible for your use of the Services (including use by others under your account, including minors residing with you). You must supervise and be accountable for all minor usage and access of the Sites under your name or account, and you absolve THE KTRUTH of any liability in this regard. You also confirm that all information provided by you or your family members for using the Services and accessing the Sites, including your name, email address, street address, telephone number, mobile number, and credit card number, is accurate and correct. Failure to provide accurate information may subject you to civil and criminal penalties.

You are responsible for acquiring and maintaining any equipment or ancillary services required to connect to, access the Sites, or otherwise use the Services, such as modems, hardware, software, and long-distance or local telephone services. You must ensure that such equipment or ancillary services are compatible with the Services.

You agree that we or our third-party service providers may send you information about various services offered by THE KTRUTH from time to time. We have the right to investigate and take appropriate legal action to prevent, stop, or deter violations of any of the aforementioned, including infringement of intellectual property rights and security issues related to the Sites and Services. We may engage and cooperate with law enforcement authorities in prosecuting users who violate these Terms of Use or the rights of any third party.

You acknowledge that we are not obligated to monitor your access to or use of the Sites, Services, or Content, or to review or edit any User Submissions or Third-Party Materials. However, we have the right to do so for the purpose of operating the Sites and Services, ensuring your compliance with these Terms of Use, or complying with applicable law or the order or requirement of a court, administrative agency, or other governmental body. THE KTRUTH reserves the right, at any time and without prior notice, to remove or disable access to any THE KTRUTH Content, Third-Party Materials, User Submissions, or any other content that THE KTRUTH, at its sole discretion, deems to be in violation of these Terms or otherwise harmful to the Site or Services.

18. Prohibited Activities

You agree not to host, display, upload, modify, publish, transmit, store, update, or share any information or User Submissions that:

a. Belongs to another person without proper authorization;

b. Is defamatory, obscene, pornographic, pedophilic, invasive of privacy, insulting, harassing based on gender, libelous, racially or ethnically objectionable, promotes money laundering or gambling, or violates applicable laws;

c. Harms children;

d. Infringes on any patent, trademark, copyright, or other proprietary rights;

e. Violates any currently enforced law;

f. Deceives, misleads, or knowingly communicates false or misleading information;

g. Impersonates someone else;

h. Threatens the unity, integrity, defense, security, or sovereignty of India, foreign relations, public order, or insults other nations;

i. Contains viruses or any other computer code or program designed to interrupt, destroy, or limit the functionality of any computer resource;

j. Is patently false, intending to mislead or harass for financial gain or causing harm to others;

k. Threatens public health or safety, or promotes cigarettes, tobacco products, alcohol, or Electronic Nicotine Delivery Systems (ENDS) & similar products, except as approved under applicable laws;

l. Threatens critical information infrastructure;

m. Contains misleading information about its origin;

n. Contains objectionable content.

You understand and agree that THE KTRUTH may, at its sole discretion, review User Submissions and delete or remove them without notice for any reason or without assigning any reason.

Any content or comment uploaded by you is subject to relevant Indian laws and may be disabled or investigated under appropriate laws if found non-compliant with laws, regulations, these terms, or the site's privacy policy. Additionally, unlawful content will be removed upon notification by a government agency or a court order as required under applicable laws.

THE KTRUTH reserves the right to preserve records of transmitted content as required under applicable laws.

19. General Terms

Relationship: None of the provisions of these Terms shall establish a partnership or agency between you and THE KTRUTH. This agreement is solely for your and THE KTRUTH’s benefit, except for permitted successors and assigns under this Agreement.

Assignment: You may not transfer any rights to use the Services. Any attempt to do so is void. THE KTRUTH may assign, transfer, delegate, or grant its rights under this agreement.

Geographic Limitation: The Sites and/or the Services are intended for use within India. If you access them from other jurisdictions, you do so at your own risk and are responsible for compliance with local law.

Collection and Use of Personal Information: Your use of the Sites and Services is governed by THE KTRUTH’s Privacy Policy. By agreeing to these Terms, you agree to abide by THE KTRUTH’s Privacy Policy.

Access to Use: You are responsible for maintaining the confidentiality of your account. You are entirely responsible for all activities conducted under your account. If THE KTRUTH believes your account is being misused, it reserves the right to cancel access rights without notice.

Availability: Content availability may change, and you are responsible for all Internet access charges.

Limited Time to Bring Claim: Any cause of action arising from the use of the Sites or Services must be filed within one year after it accrues.

Survival: Rights and obligations under these Terms that should survive termination will remain in effect after termination.

Non-Waiver: Failure to exercise any right under this agreement does not constitute a waiver.

Entire Agreement: These Terms constitute the entire agreement and supersede all prior agreements.

20. Disclaimer of Warranties and Liability

THE KTRUTH provides the Services on an "as-is" and "as-available" basis. Use of the Sites or the Services is at your risk. All warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, are disclaimed.

THE KTRUTH does not guarantee the accuracy, adequacy, reliability, completeness, or applicability of information. It does not warrant uninterrupted, timely, secure, or error-free service. THE KTRUTH is not responsible for the compatibility of its software with other third-party software or devices, nor does it guarantee that the Services will not disrupt other software or hardware.

THE KTRUTH is not liable for any content posted by third parties, including derogatory, threatening, defamatory, obscene, or offensive content. THE KTRUTH is not liable for errors in the Sites, and users are solely responsible for their interactions and transactions.

THE KTRUTH and its affiliates shall not be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising from the use of the Sites or the Services.

In the event of THE KTRUTH's liability, it is limited to the subscription charges paid by you in the preceding month.

21. Governing Law and Jurisdiction

This agreement is governed by Indian laws. New Delhi courts have exclusive jurisdiction over disputes arising from this agreement.

22. Third-Party Products, Services, and Offers

Third-party promotional Content on the site is your responsibility to review. THE KTRUTH is not liable for Third-Party Promotional Content or websites. Users assume all risks and responsibilities for accessing, using, or relying on Third-Party Promotional Content. THE KTRUTH does not promise to remove Third-Party Promotional Content from the Sites or Services. Third-party promotional Content payments are non-refundable, and THE KTRUTH can cease displaying them without prior notice. Users must verify and accept Third-Party Promotional Content Terms and Conditions before using them.
